Terms of Service

Membership is open to people who genuinely own or control the domain they bring to the exchange. To be eligible you must:

• Be at least 18 years old and able to enter a binding contract.
• Own or be authorized to act for the domain you submit, and prove it by adding the DNS TXT record we give you. Self-declared ownership is not enough; if you can't control the DNS, you don't get in.
• Pass our automated vetting (domain age, authority, spam score, and liveness) before approval. We decide who meets the bar, and we can decline any application for any lawful reason.
• Provide accurate information. Everything you tell us about you and your domain must be true and kept current.

You're responsible for your account: keep your password private, keep your email reachable, and don't share your login. Everything done through your account is treated as done by you. Tell us right away at support@backlinkhell.com if you think someone else has gotten in. One account per person unless we agree otherwise in writing.

Each approved domain has a one-time $1.99 activation fee. While the first 100 founding seats remain open, a member's first approved domain activates free. Each additional approved domain still carries the per-domain fee. The fee is never recurring and is collected only after that domain is approved. Rejected domains are never charged.

All fees are non-refundable. The activation fee, and every paid add-on described below, are final once paid. The single, narrow exception is our Integrity Guarantee, spelled out in our Refund Policy. Nothing else in these terms creates a right to a refund.

Members keep the exchange worth being in. Don't:

• Misrepresent your domain, your metrics, your identity, or your intent.
• Spam other members, scrape the registry, or use the platform to build link schemes that violate search-engine guidelines.
• Submit domains you don't control, or that host malware, illegal content, or deceptive material.
• Abuse, threaten, or harass other members or our staff; or try to break, probe, or overload the platform.

We may suspend or permanently remove any member for misrepresentation, spam, abuse, or any breach of these terms, at our sole discretion, with or without notice. Removal for cause forfeits your fees; you are not owed a refund except under the Integrity Guarantee.

Backlink Hell is an introduction and verification service. We vet members, publish trust metrics, and give you the tooling to find and talk to each other. That's where our role ends.

Any link, placement, or arrangement between members is strictly between those members. We are not a party to it, we don't negotiate it, guarantee it, escrow anything, or enforce it. If another member drops a link, changes terms, or never delivers, that's a matter between you and them. Deal with people the way you'd deal with any stranger on the internet: carefully.

We do not promise rankings, traffic, indexing, authority gains, or any SEO result whatsoever. We don't control search engines, and neither do you. We also don't guarantee that any member keeps a link live, keeps their metrics where they were, or stays in the exchange.

Trust metrics come from third-party and public sources; they move over time, for everyone. What we guarantee is only what we say in the Integrity Guarantee: that the data we show you is the data we actually measured.

Backlink monitoring is free and uncapped for every member while founding seats remain open. After founding closes, we may offer paid per-domain monitoring bundles. We may also offer optional paid add-ons, including featured listings, bold or highlight upgrades, and sponsor slots. Where an add-on is a subscription:

• It renews automatically each billing period until you cancel.
• Cancellation takes effect at the end of the current billing period. You keep the service through the period you already paid for, and are not billed again.
• There are no partial or prorated refunds for a cancelled or unused period.

Monitor results are informational only. When the monitor reports that a link is missing, nofollow, or JS-rendered, that's a data point about a third-party site we don't control. It is not a defect in our service and is not grounds for a refund. We may change, price, or discontinue any add-on at any time.

Every account gets a referral link automatically, whether or not you've listed a domain. You don't need to be invited or apply. Using it means these terms apply to any commissions you earn:

• Tier 1, your own referrals: 30% of payments we actually collect from a member you referred, for that member's first 12 months as a customer.
• Tier 2, your recruits' sales: 10% of payments collected from a member referred by an affiliate YOU recruited (someone who signed up through your link), same 12-month window.
• Hard cap at two tiers. No exceptions. We never pay a third tier or deeper. There is no fee to become an affiliate, and compensation always derives from a real product payment, never from recruiting itself. This is a standard two-tier referral program, not a multi-level or pyramid scheme, and we designed it, and cap it, to stay that way.
• If you were referred by someone and later become an affiliate yourself, that person is automatically your tier-2 recruiter, with one attribution captured the first time you touched our site and reused for both roles.
• Commissions accrue only on payments actually collected, not on sign-ups, clicks, or invoices that never clear.
• Earnings are held for a 45-day maturity period before they can be paid out. A refund or chargeback on the underlying payment reverses the related unmatured earnings.
• If a referred member cancels, future accrual on that member stops; already-matured earnings are unaffected.
• You may redeem earnings as account credit with a 15% bonus instead of cash.
• Fraud, self-referral, or gaming the program forfeits all affiliate earnings and can end your membership.
• US affiliates must submit a valid W-9 before any cash payout. The minimum cash-out is $50, paid via PayPal.

You can close your account at any time. We can suspend or terminate your access for breach of these terms, for conduct that harms the exchange or its members, or if required by law. On termination your right to use the platform ends immediately. The following sections survive by their nature: fees already paid, no-refund, disclaimers, limitation of liability, indemnification, and governing law.

The platform is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the platform will be uninterrupted, error-free, or that any metric, monitor result, or vetting outcome is complete or perfectly accurate. You use the exchange, and act on what other members tell you, at your own risk.

To the fullest extent the law allows, Backlink Hell and its owner are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost traffic, lost rankings, or lost data, arising from your use of the platform or your dealings with other members.

Our total liability for any claim relating to the platform will not exceed the greater of the amount you paid us in the 12 months before the claim, or $50. Some jurisdictions don't allow certain limits; where that's true, these apply to the extent permitted.

You agree to defend, indemnify, and hold harmless Backlink Hell and its owner from any claim, loss, or expense (including reasonable legal fees) arising out of your use of the platform, your content or domains, your dealings with other members, or your breach of these terms.

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute that isn't otherwise resolved.

We may update these terms as the platform grows. When we do, we'll revise the effective date at the top and, for material changes, give reasonable notice. Continuing to use the exchange after a change means you accept the updated terms. Questions? Email support@backlinkhell.com.
